Prop 65
What is Prop 65?
You may have seen the following warning labels on some of our products:
⚠️WARNING: This product contains chemicals known to the state of California to cause cancer, birth defects, or other reproductive harm.
⚠️WARNING: Cancer and Reproductive Harm WWW.P65WARNINGS.CA.GOV
We understand your concerns about the California Proposition 65 warning included on our headwear. This label does not mean that our products will inevitably cause cancer or reproductive issues. We believe our products are safe when used as intended (so, please wear it—don’t eat or lick it!). However, we provide this warning in accordance with California law.
The state of California passed the California Safe Drinking Water and Toxic Enforcement Act of 1986, commonly known as "Proposition 65." This law is very broad and applies to any business that operates in California, sells products in the state, or manufactures goods that could end up in California.
Proposition 65 mandates warning labels on any product that contains or might contain any of the 700+ chemicals the California Air Resources Board deems potentially harmful. Many of these chemicals have been used in everyday consumer products for years without any documented harm.
Since the penalties for failing to comply with Proposition 65 are significant, and because there’s no penalty for issuing a warning that isn’t strictly necessary, we—like many other manufacturers—have opted to include the Proposition 65 label to minimize potential liability.
